Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the corporate website at polarigroup.com (the “Site”), operated by Polari Group LLC, a New Mexico limited liability company (“Polari Group,” “we,” “us,” or “our”). Please read these Terms carefully.
By accessing or using the Site, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the Site.
1. About the Site
The Site is an informational corporate website. It exists to describe Polari Group — the company — and the products we build for the LGBTQ+ community. The Site does not itself provide any product or service, has no user accounts, and processes no transactions.
Our products, including Cruise, are separate offerings, each governed by its own terms of service and privacy policy. Nothing on the Site forms part of, or modifies, the terms of any product. For the terms specific to Cruise, see thecruise.app/terms.
2. Eligibility
You must be able to form a legally binding contract to use the Site. The Site is intended for a general business audience and is not directed to children. Our products carry their own eligibility and age requirements, stated in their respective terms.
3. Intellectual Property
The Site and its contents — including text, design, layout, graphics, logos, the “Polari Group” name and mark, the “Cruise” name and mark, and the selection and arrangement of all of the foregoing — are owned by Polari Group or its licensors and are protected by United States and international intellectual property laws.
We grant you a limited, personal, non-exclusive, non-transferable, and revocable license to access and view the Site for your own informational, non-commercial use. This license does not permit you to copy, reproduce, republish, distribute, modify, frame, or create derivative works from the Site, except as expressly permitted in the section below or by applicable law.
4. Brand and Press Assets
We make certain brand assets — such as Polari Group and Cruise logos — available for press and editorial use. You may use those assets to identify and refer to Polari Group and its products in news reporting, commentary, and similar editorial contexts, provided that you do not alter them, do not use them in a false or misleading way, and do not use them to imply a sponsorship, endorsement, partnership, or affiliation that does not exist. We may modify or revoke this permission at any time. Any other use of our names, logos, or marks requires our prior written consent.
5. Acceptable Use
When using the Site, you agree not to:
- use the Site for any unlawful purpose or in violation of these Terms;
- attempt to gain unauthorized access to the Site, its servers, or any related systems or networks;
- interfere with, disrupt, or place an unreasonable load on the Site or its infrastructure;
- introduce malware, viruses, or any other harmful or destructive code;
- scrape, harvest, crawl, or collect data from the Site by automated means, except for legitimate, well-behaved search-engine indexing; or
- use the Site in any manner that could disable, overburden, damage, or impair it, or interfere with anyone else’s use of it.
6. Third-Party Links
The Site contains links to websites and resources operated by third parties, including our own product websites such as thecruise.app. We provide these links for convenience only. We do not control third-party websites and are not responsible for their content, products, services, or privacy and security practices. Visiting any third-party website is at your own risk and is subject to that website’s own terms and policies.
7. Disclaimers
The Site is provided on an “as is” and “as available” basis, without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by law, Polari Group disclaims all warranties, including the implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We do not warrant that the Site will be uninterrupted, timely, secure, or error-free, that defects will be corrected, or that the Site is free of harmful components. We do not warrant that the information on the Site is accurate, complete, or current. The Site is provided for general informational purposes only and does not constitute legal, financial, or other professional advice.
8. Limitation of Liability
To the fullest extent permitted by law, Polari Group and its members, managers, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or relating to your access to or use of — or your inability to access or use — the Site, whether based in contract, tort, negligence, strict liability, or any other legal theory, and whether or not we have been advised of the possibility of such damages.
To the fullest extent permitted by law, the total aggregate liability of Polari Group arising out of or relating to the Site and these Terms will not exceed one hundred United States dollars (US $100). Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
9. Indemnification
You agree to indemnify, defend, and hold harmless Polari Group and its members, managers, officers, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses — including reasonable attorneys’ fees — arising out of or in any way connected with your use of the Site, your violation of these Terms, or your violation of any law or the rights of any third party.
10. Changes to the Site and These Terms
We may modify, suspend, or discontinue the Site, or any part of it, at any time and without notice. We may also revise these Terms from time to time. When we do, we will update the effective date shown at the top of this page. Your continued use of the Site after revised Terms take effect constitutes your acceptance of them.
11. Governing Law and Disputes
These Terms, and any dispute arising out of or relating to these Terms or the Site, are governed by the laws of the State of New Mexico, without regard to its conflict-of-laws principles. You agree that the exclusive venue for any such dispute is the state and federal courts located in New Mexico, and you consent to the personal jurisdiction of those courts.
12. General
If any provision of these Terms is held to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force and effect. Our failure to enforce any provision is not a waiver of it. You may not assign or transfer these Terms; we may assign them, including in connection with a merger, acquisition, or sale of assets. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Polari Group regarding the Site and supersede any prior agreements on that subject.
