clip Terms of Use

What clip Is

clip takes a link you supply, determines what media the page at that link publishes, and returns that information to your device so your device can download the file directly from its source. clip is a general-purpose tool: it does not host, store, index, curate, or distribute any media, and no file you save passes through our servers.

clip is not affiliated with, endorsed by, sponsored by, or connected to any platform, service, or rights holder whose links it may be able to read. Names and marks belonging to those services are the property of their respective owners and are used, where used at all, only to describe what a link is.

Your Responsibility for What You Save

This is the most important term in this document. clip does not decide what you save — you do. You are solely responsible for ensuring that you have the right to make and keep a copy of anything you save with the App.

You agree to use clip only for material that you own, that you have permission or a licence to copy, that is in the public domain or offered under a licence permitting your use, or that you are otherwise entitled to copy under applicable law. Copyright law differs by country, and a private copy that is lawful in one place may not be in another; it is your responsibility to know the rules that apply to you.

You are also responsible for your own agreements with other services. Saving material from a platform may be contrary to that platform’s terms of service. Your relationship with that platform is yours, not ours, and nothing in the App or these Terms is a representation that any particular use is permitted by any third party.

Acceptable Use

You agree not to use clip to:

• infringe the copyright, trademark, publicity, privacy, or other rights of any person;
• reproduce, republish, redistribute, sell, or commercially exploit material you do not have the right to use in that way;
• save, store, or distribute child sexual abuse material, which we report to the National Center for Missing & Exploited Children and to law enforcement as required by law;
• save material that is unlawful where you are, or use the App to harass, threaten, stalk, or harm anyone;
• circumvent a paywall, digital rights management, encryption, access control, or other technological protection measure;
• access the App by automated means, or use it at a volume or in a manner that places an unreasonable load on our service; or
• resell, sublicense, or provide the App or its resolution service to third parties as a service of your own.

We may rate-limit, suspend, or terminate access to enforce these Terms or to comply with the law.

Copyright Complaints

clip hosts no media, so there is nothing on our servers for us to take down. If you believe the App is being used to infringe your rights, write to legal@polarigroup.com with the details and we will respond appropriately, which may include terminating access for users who repeatedly infringe. Notices concerning material hosted by a third-party platform should be directed to that platform, which is the party able to remove it.

Your Library

Everything you save is stored on your device. clip has no account and keeps no copy, which means we cannot restore your library if your device is lost, reset, or if you delete the App. If a file matters to you, keep a copy somewhere else — saving to Photos is the simplest way. Do not rely on clip as the only place a file exists.

Availability

clip depends on what third-party services publish, and that changes without notice. A link that saves today may not save tomorrow, a platform may stop publishing media in a readable form, and some posts are behind a login or an age check that clip neither has nor attempts to bypass. The App is provided on an as-available basis and we do not guarantee that any particular link will work.

Subscriptions and Billing

clip pro is an auto-renewing subscription sold through Apple’s In-App Purchase and billed to your Apple Account. Unless you cancel at least 24 hours before the end of the current period, it renews automatically at the then-current price. Manage or cancel your subscription in your Apple Account settings; deleting the App does not cancel it.

Prices and the features included in the free tier and clip pro may change; we will reflect changes in the App. Payments are handled by Apple, and refunds are subject to Apple’s policies — we do not process payments or issue refunds directly.

Intellectual Property

The App, including its software, design, and the clip name and logo, is owned by Polari Group and protected by law. We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the App for its intended purpose, subject to these Terms. You may not copy, modify, reverse-engineer, or create derivative works of the App except as permitted by law. Nothing in these Terms grants you any right in the material you save; whatever rights exist in that material remain with whoever holds them.

Suspension and Termination

We may suspend or terminate your access to the App at any time if you violate these Terms or the law, or to protect the App, its users, or Polari Group. Discovery of child sexual abuse material results in immediate termination and a report as required by law. You may stop using the App at any time and erase your library with “Clear everything.”

Disclaimers

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY PARTICULAR LINK WILL RESOLVE OR SAVE. WE MAKE NO REPRESENTATION THAT ANY PARTICULAR USE OF THE APP IS LAWFUL IN YOUR JURISDICTION OR PERMITTED BY ANY THIRD-PARTY SERVICE.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, POLARI GROUP WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA OR SAVED FILES, ARISING FROM OR RELATED TO YOUR USE OF THE APP. TO THE EXTENT LIABILITY CANNOT BE EXCLUDED, IT IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US FOR THE APP IN THE 12 MONTHS BEFORE THE CLAIM, OR TWENTY U.S. DOLLARS (US$20).

Indemnification

You agree to indemnify and hold harmless Polari Group from any claims, damages, liabilities, and expenses — including reasonable attorneys’ fees — arising out of your use of the App, the material you choose to save, your violation of these Terms, or your violation of any law or the rights of a third party, including any intellectual property right.

Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the effective date shown at the top of this page. Your continued use of the App after changes take effect constitutes acceptance of the updated Terms.

Governing Law

These Terms are governed by the laws of the State of New Mexico, without regard to its conflict-of-laws rules. The exclusive venue for any dispute that is not subject to arbitration or small-claims court will be the state and federal courts located in New Mexico.
